I’m not offended by Alston’s article as such. It is typical of its type and has nothing new to say. What is new is such a prejudiced, anti-intellectual article being presented in a curated media platform that is claiming to be the voice of academia.

I’m angry about the values of such publications and institutions that they condone and perpetuate anti-sex attitudes, because these attitudes represent and support discriminatory behaviour.

Given that Alston has never published anything on porn before and offers only opinion, not evidence, she does not qualify as an expert in this area and her article does not qualify as academic work, and therefore it should not been published in The Conversation.

Valid, and I concede also that it is hard to write for an audience both as broad and as specialized as this message needs to reach.

I disagree with Alston’s article on a personal level, but it’s necessary for me to consider it as a published opinion piece and point out that there is still room in this interpretation for accusations that you are merely offended by the content of her opinion.

Regardless, I do think you’re correct with regards to academics and the media, and I agree that this is a practical problem. Luckily, as you earlier pointed out, we are no longer limited by monolithic publishing platforms… though they still tend to give the reader a sense of community.

Good luck pushing it in a more reasonable direction, i’ll be attempting the same elsewhere.

My initial experience of my exchange with The Conversation from February suggested to me that they had no interest in reviewing their authorial policy.

In relation to their editorial policy, they make claims to authenticity and integrity that they fail to uphold and maintain. They claim to be the socially relevant voice of academia. The professional sex educators I know would be appalled by the judgemental attitude about consensual sexual practices in Alston’s article. Her article is simply not academic or professional. It is prudish anti-sex propaganda.

Academics have long failed to gain a foothold in mainstream media as a means of sharing their expertise with the broader community. It is ironic that The Conversation, as the supposed voice of academia, has built its own media platform to better speak to and with the broader community it has abandoned its standards and has published the kind of subjective rubbish usually seen in the News Ltd titles that have long rejected academia as socially irrelevant.

No, you’re totally missing the point this time.

If it’s possible for me to draw this conclusion so easily from the article (or if you’re pushing it into my face despite the obviousness of your self publishing), it detracts from the point in your previous response and the article as a whole. You cannot blame your reader for failing to assume your own premises, or for not sharing your personal feelings about a personal experience.

It’s quite easy for me to say in response to your objection that there are other academically oriented publication sites available, and that Ms Alston is a well known academic and the head of two separate social science units at a G8 university… This is normally something that is considered to carry weight and prestige in the academic world. I conceede that this probably reduced the weight of editorial pressure on her, but it’s also possible that your expectations regarding the editorial process differ from the editors themselves. If you think that hunting prestige is ignoble, or that in that case it detracts from the academic merit of the work by lowering scruitiny, then i generally agree with you… but that’s not what this is about, based on your previous responses to me.

If you’d approached this issue differently it could have been a catalyst to a policy change by The Conversation.

You’re totally missing the point. I don’t care that they haven’t published my work as such. I self-publish.

I am pointing out that they would not accept my work, regardless of how good it may be and despite the fact I have a PhD, because I do not work for an institution, but they do accept subjective moralistic rubbish like Alston’s article, which fails the standards of academic rigour, simply because she is employed by a university.

This demonstrates that The Conversation has poor editorial standards and fails to uphold measures of intellectual integrity. It’s an ironic comparison. Do you get it now?

Thanks for your detailed response. I will amend my article accordingly. However, the legal detail about the lease does not alter the premise of my argument.

The school’s unwillingless to negotiate a new post-2015 lease in 2012 cannot, on its own, be reasonably interpreted as demonstrating an immediate threat to the survival of the cinema. FOTAA has not produced sufficient evidence to support its claim that the cinema was then under threat.

Its campaign to ‘save’ the cinema from this non-existent threat was therefore based on a false premise. Its actions to turn public opinion against the cinema’s previous landlord were disingenuous and ultimately non-productive.

FOTAA may claim victory in forcing a change of building ownership (from a conservative institution with long-term plans) to an elderly individual (with no plans), but what kind of a victory is this?

Has it made the cinema more secure? If tenant and landlord are now hiring lawyers to fight each other, the plausible answer is ‘no’.

No I am saying that the law does dictate that a notice under the old lease could not be issued at that time. You are correct.

But a new lease could be drawn up and signed. For example say the lease was expiring next in 2015 and St Michaels was approached by Hoyts who wanted to lease the cinema for fourty years. They would sign a new lease with Hoyts and at 12 months send a notice under the old lease to the Astor saying that the lease would finish at the end of its current term. Not being offered a new lease does not imply a document of notice has all.
Landlords can always negotiate. They could sign a new lease with the Astor at any time. If the law operated as you described it would breech all sorts of federal laws regarding commerce created under the trade and commerce powers. They would not be constitutional and the commercial real estate sector would be inefficient.
I’ll give you an actual example. I negotiated a lease for a commercial building which had a five year stepping stone rent where the rent increased every year. Then the tenant had 5, 5 year options. After the first six years the tenant was happy and didn’t want to have the rent changed under the lease every 5 years. So they were given a 25 year lease with increases linked to c.p.i. The old lease was altered by consent of both parties. No notices were given or had to be given.
What I’m saying is that a landlord can offer a new lease whenever the want. They can only send a formal notice under certain circumstances and the two things are very different.
A notice is a very specific document, it is like if someone went to your door after you failed to pay your mortgage and you got a repossession notice. It’s not negotiation or discussion. I don’t know what happened in this case. The School could not issue a notice that the lease would not be renewed more than a year out from the end of the lease. They could however say that was there intention if they pleased.
They should do what the astor in perth did and turn it into a band venue.

I think we’re disputing the meaning of the words not the law. FOTAA implies that informal or preliminary discussions have occurred about a future lease but as the spokeperson for the cinema, Tara Judah, said in 2012 ‘We have not been offered a new lease by our current landlord, St Michael’s Grammar School’. This implies a document of notice as you describe that formalises the terms of a new lease. As the law dictates, the landlord could not offer a new lease at that time.

He was a wonderful man, a brilliant artist and a complex individual to say the least.
Any of you that claim all this boiled up venom just didn’t know him.
He was like like many artists full of contradictions. But know he was a son, a nephew a cousin and mate and greatly loved. Because regardless of what you may think he gave with all his heart and his heart was huge.

No I read that. It says the landlord must deliver a notice. The notice is the key.
It’s not ‘notice’ i.e a phone call or general letter. It is a document that is proscribed in the act that must:
• offer the tenant a renewal of the lease (on the terms specified in the notice); or
• inform the tenant that the landlord does not propose to offer the tenant a renewal of the lease.
The time period by which the landlord must provide the notice is at least 6 months, but no more than 12 months, before the expiry date.

So they deliver a notice between 6 and 12 months. Delivering a notice under the act does not stop any other form of negotiation or offer being made. Leases can be cancelled, changed altered set on fire or otherwise dealt with between two parties acting in good faith whenever they please. The notice is a document which outlines what is going to happen at the end of the lease period. It’s not an offer so much as an direction. The lease will end or it will continue under specific terms. The economy would grind to a halt if tenant and landlords could not negotiate.

The legislation is there is stop for example a land lord turning up and changing the locks once day when the tenant has not been aware the lease is ending.
The idea that a landlord would be stopped by law negotiating with a tenant
would not be in anyone’s interest. It would for example stop a land lord offering to lower the rent for a struggling tenant.

You have with respect misinterpreted the law in this case.

You’ve missed what it says at the bottom under ‘What notices are required of the landlord when there are no options to renew?’ – the same 6-12 month window applies, so this suggests a landlord cannot initiate discussions about a new lease more than 12 before the current one expires.

We are regular visitors to Metung, but now irregular visitors to the Galley, due to many of the problems you have hilited. Our last dinner there, our water glasses sat empty all night, I became determined not to ask for water, the more I saw the waiter regularly filling the glasses at the next table… Service can be very patchy, or great, depends which way the wind is blowing. When they were at the old place across the road, service was always spot on. Next time, try the smaller mum & daughter run place Bancroft Bites.

Please provide links to the Astor blog posts you claim contain useful information. I found nothing worth referring to. You don’t know what information I was privy to but as I clearly explain I have written this article with reference to publicly available information.

I aimed to provide a detailed analysis of the whole Astor scenario and have critiqued the actions of all the participants. I haven’t taken sides. I am not ‘singing the school’s song’ and it is obvious that I am critical of the school as well as FOTAA, such as in my comments on the school’s use of social media.

Finally, your claim that I ‘attack anonymously’ is false when I publish my real name on my site (it’s on the right sidebar menu of every page). Feel free to play the ball not the man. Don’t shoot the messenger. And other cliches…

Those are excellent questions, and it would be fascinating to hear FOTAA answer them. I can only hypothesise. I see it primarily a conflict about class and culture.

FOTAA positioned itself as the youthful inner city colourful pop culture champion of a retro vintage artefact (the repertory cinema). FOTAA is a gen Y hipster.

FOTAA implied that the school and its customers (management and parents) were ageing, beige, suburban, money driven, uncultured (or at least not interested in pop culture like cinema) people who had no respect for history. The school community is the hipster’s baby boomer parent who has told their hipster kid to grow up, get a job and move out of the family home.

I have no idea how much of a crossover there is between the school community and the Astor cinema audience. It seems that FOTAA saw it as minimal.

I think FOTAA has been incredibly naive about the economics at the heart of the matter. They positioned the dispute in cultural terms and ignored the fact that the cinema is reliant on the building. You can’t save the cinema without saving the building. They lost sight of this.

It’s good to finally read a non-hysterical account of this whole saga. Even the papers can’t cover the Astor without (intentionally or unintentionally) fanning the flames in some way.

What then, in your opinion, were FOTAA’s motivations in disrupting the relationship between St Michael’s and the cinema? That’s the big “why?” question that I get from reading this. Why, and to what end, did they choose to rock the boat?

Legal Deposit may be mandatory but no one in Australia has ever been prosecuted or fined under the LD provisions of the Copyright Act by the NLA. The NLA and the state libraries appreciate that their ability to impose the situation on ebook self-publishers is impossible, they don’t try. It is the same with respect to zines (http://blogs.nla.gov.au/the-eloquent-page/category/zines/) or artists’ books, which for many intents and purposes operate in the same space from the perspective of LD. Libraries can read the law, but as with many laws their it comes down to their application. All deposit libraries are selective about how they acquire material, so very local (suburban) material such as school newsletters aren’t collected by the National Library; although they are covered by the LD provisions, they are outside the collection development policy (http://www.nla.gov.au/content/collection-development-policy-australian-collecting). The LD provisions are wide enough to enable the laws to be less format specific and more flexible, but it is not intended as an impost. Yes, these laws were formed in Britain around the Stationers Co et al. and may seem anachronistic, but they have moved with the time and they aren’t trying to be an impost on small publishers.

With respect to PANDORA, all listings of archived websites clearly state up front that the current version of the archived website (which is linked and comes before the listing of each of the archived versions) is the most up to date and that each iteration that is archived is snapshot at that point in time. Given the relevance ranking of PANDORA I can’t imagine that it would come up before the original site, but even if it did, it is very clear that the current version is the one they can link to first up.

The proposed changes to the copyright provisions largely relate to whole of domain harvests, which they have already got the USA-based Internet Archive to do on their behalf (http://www.nla.gov.au/content/preservation-intent-web-domain-harvests) a couple of times. The Internet Archive, via their Wayback Machine, had already been undertaking domain harvests previously, so they may already have a snapshot of your blog.

It’s all about cutting cost employing as little staff as possible . They have just sacked all 200 truck drivers in Victoria and replaced them with contractors on half the money .

The store managers are on very little money . So if you pay peanuts you get monkeys . Go to Coles

Not me. The branding of the restaurant is amateurish and terrible, and the online marketing is non-existent. To me it looks unprofessional and this suggests (like Cruzao) that the service may be unprofessional too.

I feel sorry for them but they don’t seem to know what they are doing. It looks closed even when it is open, you can’t hear music coming out to create some atmosphere and they don’t have an A frame sign or anything on the street to draw attention to themselves.

Finally, having been to the US earlier this year and eaten at places like this, the drinks in the US are so cheap and the drinks at this place seem too expensive.

Has anyone had a chance to check this place out? I wandered past on Friday night and it was deserted. I’ve only found a single one-sentence review, which was positive if perfunctory, but the place doesn’t even have an entry in Urbanspoon or Tripadvisor.

I was told the employer was the City of Melbourne and the role was to work on That’s Melbourne, which is built on Sharepoint. Sharepoint has its complexities and is often clunky and counter-intuitive (well it is built by Microsoft). It’s fair enough for the employer to expect immediate competency in a short term contract role. More flexibility and training can be expected in permanent roles. I had everything required in the selection criteria but was messed around by the agency I was in contact with and they never followed through on telling me what was happening or what happened with the role.

I applied for that role I think, is hard to work out what employer it is for as they never list it. I had one recruiter that would not even consider me as I did not have Sharepoint and its not like I could learn it on the job after using half a dozen other ones, what?! Skills shortage my arse, if people won’t train anyone what do they expect?

I cannot stomach the Fairfax press, and support the News Ltd press because, no matter how tabloid they may be at times, at least their websites are not ideological drivel trying to masquerade- hopelessly – as some sort of serious press.

Having said that, I too find myself cringing more and more at how low News Ltd is stooping by blatantly and lazily ripping off whichever reddit.com post takes their fancy.

They reached a new nadir a day or so ago with the rehash of a post about creepy things kids say, to the extent that it listed reddit commenter’s names along with their posted comments.

It was industrial grade cringe, and I felt embarrassed for whichever online News Ltd editor gave it the go-ahead.

You don’t know who I ‘deal with’ or what my experience is. How arrogant of you to assume without any evidence the limits of my experience. I have not only dealt with websites in my publishing career.

Your claim to authority is entirely unsubstantiated and your knowledge of contracts regarding creative content is spurious. Ask freelance photographers and the agencies that manage their portfolios about moral rights. They don’t give up moral rights because if they did they would not be able to establish a reputation based on their work.

Fiction and academic authors don’t give up moral rights and this is not an issue in book publishing. I know because I managed such contracts for years.

So tell me an industry segment in Australia where you can demonstrate that giving up moral rights is common. I doubt you can because you’ve been talking nonsense from your first comment.

You get one more comment only before I block you. You can try to prove your case or simply continue to demonstrate your stupidity. Think wisely if you’re capable of it.
